Trump and Biden ironically may need to rely on each other in order to maintain or assert privilege over communications they’d like to keep under wraps.

The White House has invoked executive privilege to block the release of an audio special counsel interview with President Joe Biden.

The move comes just hours before the two House panels are set to begin drafting a resolution to hold Attorney General Merrick Garland in contempt.

Former Trump adviser was sentenced in January to four months for contempt of Congress after refusing to comply with a subpoena from the House Jan. 6 Committee.

The former president is willing to ‘intervene in any litigation involving these privileges,’ his attorney said in a letter.

Special counsel Jack Smith is asking the Supreme Court to rapidly accept a case regarding former President Donald Trump and executive privilege.
