Republican attorney Stephen Weiner and Democrat Cassandra Johnson are vying to replace Queens Surrogate Court Judge Peter Kelly in November.

The defense argued that the former president has First Amendment, Sixth Amendment, due process, and statutory grounds to demand a public proceeding.

The court also should set an expedited schedule if any judgment should be stayed while the former president appeals his case, the office said.
