A man charged over the Jan. 6, 2021, breach of the U.S. Capitol is still in custody after prosecutors brought fresh charges in the wake of President Donald Trump’s wave of pardons for Jan. 6 defendants.
Daniel Ball was arrested on Jan. 22 in Washington, according to an arrest warrant filed with the federal court system in the city, a day after a federal judge granted a request by U.S. prosecutors to drop Jan. 6-related charges against Ball.
Ball was arrested on charges of illegally possessing a gun and ammunition despite previous felony convictions, according to an indictment filed in Florida.

A page attached to the warrant says that Ball, a Florida resident, “is a two-time convicted felon with prior convictions for domestic violence battery by strangulation and resisting law enforcement with violence.” The warrant was signed on Aug. 6, 2024, but not executed until this week.

It’s unclear why the warrant was not executed until now. The U.S. Department of Justice did not respond to a request for comment.

Ball was arrested while still in prison in Washington, his lawyer, Amy Collins, told The Epoch Times.

According to the indictment, Ball’s illegal firearm possession was discovered on May 2, 2023.

Authorities arrested Ball in the Jan. 6 case on May 2, 2023.

Trump’s order grants full, complete, and unconditional pardons to people convicted of crimes “related to events that occurred at or near the United States Capitol on January 6, 2021.”

It directs the attorney general to immediately issue certificates of pardons to Jan. 6 defendants and ensure that people convicted of Jan. 6-related offenses and currently held in prison are “released immediately.”

“I further direct the Attorney General to pursue dismissal with prejudice to the government of all pending indictments against individuals for their conduct related to the events at or near the United States Capitol on January 6, 2021,” Trump wrote.

Collins said that Ball’s lawyers think the new case should be dismissed under the pardon.

“Among other things, it results directly from the search warrant executed in the January 6 case,” Collins said.

Ball had been facing multiple charges linked to the Jan. 6, 2021, breach of the U.S. Capitol, including assaulting, resisting, or impeding law enforcement officers while using a dangerous weapon.

Video footage allegedly showed Ball entering the Capitol without permission, stealing a piece of a window shutter from inside, and assaulting Metropolitan Police Department and U.S. Capitol Police officers, according to charging documents.

Prosecutors said that Ball at one point hurled a device that exploded inside a tunnel leading to the Capitol and also threw a chair or table leg at officers there.

Ball, who had pleaded not guilty, has been in custody since 2023 because a magistrate judge found that no conditions would reasonably assure the safety of the community if he were granted pretrial release.
