A former California correctional officer has been charged with three new allegations of sexual assault related to an original 12-count indictment, prosecutors announced last week.

Daryl Wayne Smith, 55, was indicted in 2023 on a dozen counts alleging he engaged in illegal sexual acts with three female inmates while employed at the Federal Correctional Institution in Dublin—about 40 minutes southeast of Oakland.

The latest indictment issued July 25 identifies two additional victims and adds two counts of sexual abuse and a third count of a federal civil rights violation.

Mr. Smith has now been charged with six counts of sexual abuse of a ward, one count of aggravated sexual abuse, seven counts of abusive sexual contact, and one count of deprivation of rights, according to prosecutors.

“As alleged, Officer Daryl Smith engaged in appalling criminal acts when he sexually abused those in his care and custody,” said Deputy Attorney General Lisa Monaco in a statement.

According to prosecutors, Mr. Smith’s alleged sexual misconduct was initially thought to have taken place between 2019 and 2021. However, prosecutors said they now believe it allegedly began as early as 2016.

“Sexual abuse scars everyone who survives it but can be particularly traumatizing when it’s perpetrated by someone in a position of trust or authority,” said Michael D. Nordwall, executive assistant director of the FBI’s criminal, cyber, response, and services branch.

He also called the allegations “some of the most disturbing charges we’ve seen for a former federal corrections officer.”

Each victim was an inmate at the Dublin correctional facility and allegedly suffered abusive sexual conduct by Mr. Smith while under his control, according to prosecutors.

Mr. Smith currently lives in Florida, authorities said, and his arraignment has not been set. A jury trial date has been scheduled for March 2025, in the Northern District of California.

He faces a maximum life sentence in prison for each count of aggravated assault and deprivation of rights. He also faces another maximum of 15 years in prison for each count of sexual abuse.

He may also be fined up to $250,000 for each count, restitution, and other assessments, authorities said.
