U.S. Attorney General Pam Bondi said Thursday that some of the judges who ruled against the Trump administration’s executive orders in recent days need to be removed.
She named three federal judges who have temporarily paused President Donald Trump’s policies, including U.S. district judges James Boasberg, Beryl Howell, and Ana Reyes. Bondi then said that Boasberg, who ordered the administration to stop invoking the Alien Enemies Act to deport illegal immigrants accused of being members of transnational gangs, shouldn’t rule on any Trump administration case.
“They are district judges trying to control our entire country, our entire country, and they are trying to obstruct Donald Trump’s agenda,” Bondi said.
Her comments come as House Speaker Mike Johnson (R-La.) told reporters on Tuesday that Congress could intervene in the court system by restructuring, defunding, or eliminating U.S. federal courts.
“We do have the authority over the federal courts, as you know. We can eliminate an entire district court,” Johnson said, adding that his remarks are meant to illustrate Congress’s authority over the court system as a means of checks and balances.
“We have power of funding over the courts and all these other things. But desperate times call for desperate measures, and Congress is going to act,” he added.
Earlier this month, Trump said in a post on social media that Boasberg should be impeached following his decision to block him from using the Alien Enemies Act. Trump said that Boasberg “was not elected president” and rendered a decision that would allow for “vicious, violent, and demented criminals” to remain in the United States.
Trump’s impeachment call apparently drew a rare statement from U.S. Chief Justice John Roberts, who said that he believes it’s not appropriate to impeach a judge over a decision.
Democrats have said that they view impeachment threats and Johnson’s comment about defunding courts as an assault on the judicial branch.
“It is outrageous to even think of defunding the courts,” said Senate Minority Leader Chuck Schumer (D-N.Y.) this week in response to the House speaker’s statement. “The courts are the bulwark against Trump, and the Republicans can’t stand it.”
Boasberg has been weighing whether the Trump administration defied his order after the planes carrying illegal immigrants who are suspected foreign gang members landed in El Salvador, turned over to that country’s prison system. The Trump administration had invoked the Alien Enemies Act for the deportations, but the judge initially said the deportees were deprived of due process.
