Lieutenant Colonel Raymond Valas from Bow is charged with engaging in the sex trafficking of a minor while in the state of Texas.
Valas has been with the National Guard since 1995. According to his defense attorney lavas was arrested May 19 and he is currently in a New York jail waiting to be brought to San Antonio where the incident happened last August.
The New Hampshire National Guard says it has suspended his security clearance until the case is resolved.
John Convery, his attorney, said he could not comment on whether Valas new he was engaging in sexual activity with a minor at the time.
If convicted Valas faces up to ten years in prison and a $250.000 fine.
